Orion Hosting reserves the right to amend this document at any time without notice.

Section 1 - Definitions
-------------------------------

1. "us","the company","Orion","our","Orion Hosting" and "we" refer to Orion Internet Services Ltd., trading as Orion Hosting Services.

2. "You","the customer","the client","the user" refers to the current or potential account holders for the Orion Hosting Service.

3. "Your Server"/"The Server" applies to the Orion Hosting server(s) on which you have been or may be allocated single or multiple accounts.

4. "Account(s)" applies to anywhere that you are capable of connecting to on any of the company's servers. For example only, a Linux Shell.

5. "Anniversary Date" or "Anniversary" refers to the day/month that you commenced hosting with the company.

Section 2 - Acceptable Usage Policy
------------------------------------------------------

1. If you have access to account(s) on any of the company's servers you will not attempt to install or run any of the programs listed listed in this document. If this website is unavailable or unclear, or if you are unsure about a program that you wish to install you must contact an administrator for a clearer listing before logging in.

2. At no time will you take part in activities which may impact other users activities or general server stability. This includes but does not exclusively consist of Denial of Service Attacks, 'Fork Bombs', 'Root Kits' and IRC Floodnets. If you are unsure whether you are allowed to run something contact an administrator.

3. Under no circumstances will you willingly give out a password. Account sharing is prohibited. In the event that your account is compromised against your will by your negligence for example a password being displayed in a public place you should contact an Orion Hosting Administrator IMMEDIATELY and await further instructions. In the meantime we cannot be held responsible for any loss of data although we endaevour to provide appropriate backup facilities.

4. You are not permitted to resell the hosting facilities provided to any other party unless you have an account with the 'Reseller' option. Extra FTP users are provided for yourself and your friends, not so that you can have your own paying clients.

5. You will not store illegal material in any shape or form on any of the company's servers. This includes but does not exclusively consist of Child Pornography, Copyrighted/Trademarked Material, "Warez" and Material that could be viewed as offensive in the eyes of others.

6. Orion Hosting Services does not allow the transmission of commercial "spam" mail . That is, mass commercial mailings. Any evidence of such activities will result in instant account removal.

7. You are not allowed to run any of the following without prior consent of an Orion Hosting administrator: -

Any permanent (background) process

8. For shell accounts, If you run any program that requires a 'bind' to a port/ip you will use ports that are higher than 10000 to 'bind' to on any of the following ip address(es): -

85.234.155.92 (rigel.orion-hosting.co.uk)
85.234.155.93 (rigel.orion-hosting.co.uk)

NB: If you have bought the IP address in question from us you are free to bind to any port on that IP. For example in the case of games servers or some website customers.

Violations of these Acceptable Uses Policies should be referred to violations@orion-hosting.co.uk
All complaints will be investigated promptly. Failure to follow any term or condition will be grounds for immediate account deactivation.


Section 3 - Terms of Service
--------------------------------------------

1. Orion Hosting reserves the right to, at our discretion, at any time and without notice to: -
- Terminate, in part or completely, any Account/s.

2. In the event that part of the AUP is breached, while we prefer to first warn a customer before taking action, accounts that flagrantly defy these guidelines will be terminated without prior notice/consent.

3. Orion Hosting shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from any server going off-line or being unavailable for any reason whatsoever. Furthermore, Orion Hosting shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any data from an Orion Hosting Server or Servers.

4. Orion Hosting cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits that a client would have gained if their hosting was functioning. Orion Hosting holds no responsibility for the use of our clients' accounts. If any terms or conditions are flagrantly defied, the account in question will be deactivated as soon as possible. We reserve the right to remove any account without advanced notice for any reason without restitution as Orion Hosting sees fit.

5. Service Fees. When the monthly or yearly (as previously arranged) anniversary of your account's activation is reached Orion Hosting will transmit an invoice by email for payment within 10 days of receipt. Failure to pay without a previous agreement with a verified administrator can cause account suspension or removal. NB: If you pay yearly the same directive applies but on each annual anniversary, such agreements do NOT need to be verified with an administrator.

6. Excessive Bandwidth Charges. If your account exceeds its bandwidth quota Orion's servers will stop serving pages to your user account until:

a) The beginning of a new 'account' month (running from anniversary date to anniversary date)
b) The assertion by you (the user) that you wish to exceed your bandwidth quota at the rate of £1 per extra gigabyte used.
NB: This email MUST come from your registered email address

7. In the event of an account cancellation request being received we will not refund partial monthly payments but instead will calculate an appropriate refund, or none at our discretion.

8. Your personal information, stored on our servers will not be divulged to any third party unless it is an act required by United Kingdom Law Enforcement Agencies (Or laws recognised/enforced in the UK).
